My father said that if he gives me money as a gift, I must buy a house. Is this a type of riba statement?

Q: My father said that if he gives me money as a gift, I must buy a house.  Is this a type of riba statement? 

 

الجواب حامدا ومصليا ومسلما ومنه الصدق والصواب

A: If your father gives you some money and stipulates that you must purchase a house therewith, irrespective as to whether the money is given as a gift or as a loan, neither is this riba nor are you bound by the stipulations of your father.  The gift/loan will in itself be valid as stipulations in gratuitous contracts are themselves void whilst the contract itself is valid. However, if your father stipulates that you must return to him a lower or higher sum, then irrespective as to whether this is referred to as a gift or a loan, it will entail riba and be prohibited.
