Distribution of rental income in a joint ownership

Q: The husband and wife both bought the house together. On average they receive £630 in rent every month. The wife paid a contribution towards the deposit and in total has paid about £30k and the husband has paid off the remaining amount of about £120k.

In the recent years the monthly mortgage payment has been reduced and the husband has given£200 of the monthly rent money to the wife and keeps the rest to pay for the mortgage on the house and other expenses and also uses the money to pay for other personal expenses.

Is the above permissible for the husband or does he have to give exactly half of the monthly rent to the wife? The wife is happy with whatever the husband is doing.

الجواب حامدا ومصليا ومسلما ومنه الصدق والصواب

A: It is permissible for the husband and wife to agree between themselves whatever arrangement they wish to do so. They both have a 50% share in the property unless otherwise agreed at the time of purchase and bear equal responsibility for the expenses of the house. However, they can agree whatever arrangement the wish to between themselves.
