Q: As a private car seller, if a buyer cannot afford to pay upfront, is it permissible to sell the car to a company who then sells it at a higher price on a Hire Purchase Agreement to the initial buyer?

الجواب حامدا ومصليا ومسلما ومنه الصدق والصواب

A: If the buyer does not conclude a contract of sale with you and you sell the car to the company it will be permitted. If the buyer purchases directly from the company your sale will not be affected. However, if you sell the car to the buyer on behalf of the company on the basis of hire purchase this is not permitted as conventional hire purchase agreements do not comply with Sharī‘ah. It is also possible that the sale of the car by to the company will also not be permitted.
